The Legal Aid Agency will fund mediation for those clients who are eligible.

If one party in mediation is eligible for Legal Aid, and can provide evidence of it, then the Legal Aid Agency will also cover the other party for their MIAM as well as the first joint session. Legal Aid for mediation does not have to be repaid and is not subject to the statutory charge. If a client is currently in receipt of one of the following benefits they would automatically be eligible for Legal Aid.

    If you, or the other party, is in receipt of:

  • Universal Credit
  • Income-related ESA
  • Income-based JSA
  • Guarantee Credit
  • Income Support

  • Even if you are not in receipt of one of the above benefits you may still be eligible. You can check to see if you are likely to be eligible here by clicking on the Legal Aid calculator below:

Before your assessment you will be required to provide the following information if you wish to be assessed for eligibility for Legal Aid:

  • Proof of earnings and identification for yourself and any new partner.
  • Proof of benefits
  • This must state the type of benefit you are in receipt of as well as stating whether it is contribution or income based if appropriate. You can evidence Universal Credit with a screenshot of your last payment or by showing a payment in the last month in a bank statement. You can always request a letter in advance from Jobcentre Plus by calling them. The letter must be no more than 6 months old.

If you are working:
You will need to provide your most recent monthly payslip if you are paid monthly (dated no earlier than one month before your appointment); if you are paid weekly please bring your five most recent weekly payslips.

If you are self-employed:
You will need to bring your most recent accounts together also with last month’s Bank Statement for both Business and Personal Accounts.

  • Bank statements for all of your accounts
  • It is very important that any bank statements include the day of your MIAM meeting and go back at least one calendar month (so if your meeting is on 10th of November your statement must cover from 11th of October to 10th of November.

    If you are able to supply scanned copies via e-mail, faxed or any copy documents (all pages required) that would be great – we will return any originals you may send to us.
